The Service
OpenGen is an artificial intelligence-powered creative platform that enables users to generate, edit, transform, enhance, or otherwise create digital content.
Depending on the features available at a particular time, the Service may include, without limitation:
- Text-to-image generation;
- Image-to-image generation;
- Text-to-video generation;
- Image-to-video generation;
- AI-powered image and video editing;
- Image enhancement or upscaling;
- Background modification or replacement;
- Image restyling or transformation;
- Other generative AI tools and creative features.
Certain features may allow you to provide text prompts, upload images, photographs, videos, or other media, select generation settings, and receive AI-generated or AI-modified content.
OpenGen may provide access to technology, artificial intelligence models, APIs, infrastructure, or other services supplied by third-party providers.
The specific models, tools, features, generation limits, processing capabilities, and functionality available through OpenGen may change over time.
We may add, modify, replace, suspend, limit, or discontinue individual models, tools, features, or functionality at any time.
Unless explicitly stated otherwise, OpenGen is not affiliated with, sponsored by, or endorsed by any third-party artificial intelligence model or technology provider whose technology may be accessible through the Service.
Disclaimer: OpenGen is not affiliated with or endorsed by AI model providers. Generation requests are routed through OpenRouter to downstream AI providers; this does not imply that OpenGen has a direct service agreement with each model provider.
Use of AI Technologies
OpenGen uses artificial intelligence technologies to generate, transform, edit, or otherwise process content.
Artificial intelligence is probabilistic in nature. As a result, content generated through the Service (“Output Content” or “Outputs”) may be inaccurate, incomplete, unexpected, offensive, inappropriate, misleading, or unsuitable for your intended purpose.
Outputs may also not be unique. Other users may generate the same or similar content, and generated content may contain characteristics, concepts, compositions, or elements similar to content produced for other users or content that already exists.
You are solely responsible for reviewing and evaluating Output Content before using, publishing, distributing, sharing, selling, displaying, or otherwise relying upon it.
OpenGen does not guarantee that any Output Content:
- Is unique or original;
- Is accurate or complete;
- Is suitable for any particular purpose;
- Is eligible for copyright, trademark, or other intellectual property protection;
- Does not resemble existing content;
- Does not infringe or otherwise violate third-party rights; or
- May legally be used for commercial or other purposes in every jurisdiction.
You are solely responsible for ensuring that your use of any Output Content complies with applicable laws, regulations, contractual obligations, third-party rights, and any terms applicable to third-party AI models or services used to generate such Output Content.
Your Inputs
You are solely responsible for all text prompts, instructions, photographs, images, videos, audio, files, reference materials, and other content you upload, submit, or otherwise provide to OpenGen (“Input Content”).
By submitting Input Content, you represent and warrant that you have all rights, licenses, permissions, and consents necessary to upload and use that Input Content through the Service.
This includes obtaining appropriate authorization from any person whose face, voice, likeness, identity, personal information, copyrighted material, trademark, or other protected content appears in the Input Content where such authorization is required.
You must not upload confidential, proprietary, sensitive, or legally protected information unless you have the authority to do so and understand how that information will be processed in accordance with our Privacy Policy.
Images, Videos, and Likenesses of Individuals
You may not use the Service to create, modify, or distribute content using the face, voice, likeness, identity, or other personal characteristics of another individual without having the necessary rights or permissions where required by applicable law.
You are responsible for ensuring that AI-generated or AI-modified depictions of real individuals are not used in a deceptive, defamatory, fraudulent, exploitative, harassing, or otherwise unlawful manner.
OpenGen may restrict or block generations involving public figures, private individuals, minors, explicit content, impersonation, deceptive media, or other sensitive subject matter.
Third-Party AI Technologies
Some functionality of the Service may depend on artificial intelligence models, APIs, infrastructure, or other technologies operated by third parties.
The availability, performance, restrictions, moderation rules, generation capabilities, or output of these third-party technologies may change without notice.
Your use of certain features may therefore also be subject to restrictions imposed by the applicable third-party provider.
We are not responsible for the independent acts, omissions, availability, policies, or performance of third-party technology providers.
No Reliance on AI Output
The Service is primarily intended for creative and informational purposes.
Output Content should not be relied upon as professional, medical, legal, financial, safety-critical, or other specialized advice.
You should independently verify information and obtain appropriate professional advice when necessary.
WE MAKE NO GUARANTEES THAT:
- (i) The Service will meet your requirements;
- (ii) The Service will be uninterrupted, timely, secure, or error-free;
- (iii) Any Output Content will be accurate, reliable, unique, complete, lawful, or suitable for your intended use;
- (iv) Output Content will be free from third-party intellectual property or other claims;
- (v) Any particular AI model, tool, or feature will remain available;
- (vi) Generated images, videos, or other media will match your prompts or expectations; or
- (vii) The quality of any products, Services, information, generated content, or other material obtained through the Service will meet your expectations or provide any particular benefit.
Account Registration
To access certain features of the Service, you may need to create an account (“Account”) and provide information as requested during the registration process.
By registering an Account, you represent and warrant to the Company that:
- (i) The information you provide is truthful and accurate;
- (ii) You will keep this information up to date; and
- (iii) Your use of the Service complies with applicable laws, regulations, and these Terms.
Failure to meet these requirements may affect the functionality of the Service, and we may be unable to contact you with important updates.
The Company reserves the right to suspend or terminate your Account or access to the Service at its discretion, with or without notice, if you violate these Terms.
Payments and Refunds
Checkout displays the listed amount in USD, the credit allowance, and any renewal amount and billing period before confirmation. Live recurring billing, subscription cancellation and auto-refill are currently unavailable.
A trial provides 300 credits for 5 days; its displayed follow-on schedule is 2,000 credits per month. The renewal amount and currency are shown at checkout. Annual plans are billed for the full year while their credits are granted monthly. Unused subscription credits do not roll over. Extra purchased credits do not expire. Current renewal terms are shown on the order before confirmation.
Generation costs depend on the selected model and settings. For video, the total includes the selected duration. Costs and the available balance are shown before submission. Credits are reserved before processing, with expiring credits used before permanent extra credits. A request with insufficient credits is not sent to the AI provider. A failed generation returns eligible credits to their original balance; monthly credits that have expired or passed a reset are not restored. Generation-credit returns do not refund money.
An upgrade is charged at the listed full price without a deduction for the current plan and starts a new billing cycle. Existing monthly credits remain until the next monthly reset, and extra credits are retained. The order describes the applicable credit allowance.
Where subscription management is available, cancel renewal through Profile → Plans or Cancel Subscription. Access continues until the current period ends; remaining subscription credits then expire and extra credits are retained. Cancelling renewal does not automatically refund a purchase. Auto-refill is a separate setting and must be disabled in Profile → Plans; it is paused when the subscription ends. Its credit amount, price, currency and balance threshold are shown before enabling it.
Purchases are non-refundable to the extent permitted by law unless otherwise stated for the purchase. Mandatory withdrawal, cancellation, refund and other consumer rights under applicable law remain unaffected. Contact us through Contact Us to request review; submitting a request does not itself issue a refund.
Subscription
Paid plans provide the credits and features described in the current pricing and checkout pages. Generation is subject to available credits, model availability and supported settings; no plan guarantees unlimited generation.
Prices are in U.S. dollars and may vary in countries other than the U.S. You will have all the necessary information about your subscription plan on the Website before the purchase.
Free Tier
New accounts currently receive 25 signup credits once. These are not a monthly free allowance. Available models, settings and generation costs are shown in the studio. Additional generation requires sufficient credits, and checkout may be unavailable.
Refunds
Use Contact Us for purchase or refund questions. We do not promise an automatic refund or a fixed response time. Applicable mandatory consumer rights remain unaffected.
Intellectual Property & User Content
OpenGen Intellectual Property
The Service, including its Website, software, interfaces, designs, branding, logos, trademarks, underlying technology, databases, and other materials owned by OpenGen, is protected by intellectual property and other applicable laws.
Subject to these Terms, the Company grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service for its intended purposes.
Except as expressly permitted by these Terms, you may not copy, reproduce, distribute, sell, license, reverse engineer, modify, create derivative works from, or otherwise exploit any part of the Service.
User Content
For purposes of these Terms, “User Content” includes your Input Content and, where applicable, Output Content generated through your use of the Service.
You retain any rights you already hold in Input Content that you submit to OpenGen.
By submitting Input Content to the Service, you grant OpenGen the rights reasonably necessary to host, store, reproduce, transmit, process, modify, and otherwise use that Input Content as required to:
- Provide the requested Services;
- Generate or process Output Content;
- Maintain and secure the Service;
- Prevent fraud, abuse, or violations of these Terms;
- Comply with applicable legal obligations; and
- Exercise our rights under these Terms.
OpenGen does not train its own AI models with your Input or Output Content. Requests are processed through OpenRouter and downstream providers, whose retention and training practices vary. Their processing is described in our Privacy Policy; we do not guarantee that every provider excludes training or retains no data.
Output Content
As between you and OpenGen, and to the extent permitted by applicable law, OpenGen does not claim ownership of Output Content solely because it was generated through the Service, except for OpenGen’s pre-existing intellectual property or other materials incorporated into the Output Content.
However, the nature of generative artificial intelligence means that intellectual property rights in AI-generated material may be uncertain or vary by jurisdiction.
OpenGen does not represent or warrant that you will own copyright or other intellectual property rights in any Output Content.
We also do not guarantee that Output Content will be unique or that another OpenGen user or user of another AI service will not receive identical or similar content.
Your ability to use particular Output Content may also be subject to:
- Applicable law;
- Rights held by third parties;
- The rights associated with your Input Content;
- The terms applicable to third-party AI models or technology; and
- Any additional terms communicated through the Service.
You are solely responsible for determining whether and how you may legally use, publish, reproduce, distribute, commercialize, or otherwise exploit Output Content.
Rights and Permissions
By using the Service, you represent and warrant that your User Content and your use of the Service will not infringe or violate any third party’s:
- Copyright;
- Trademark;
- Patent;
- Privacy rights;
- Publicity or personality rights;
- Contractual rights;
- Confidentiality rights; or
- Other legal or intellectual property rights.
If your Input Content contains another person’s image, face, likeness, voice, or other identifiable characteristic, you represent that you have all required permissions or another valid legal basis to use that material.
We may remove or restrict access to content that we reasonably believe violates these Terms, applicable law, third-party rights, or applicable provider policies.
Repeated or serious violations may result in suspension or termination of your Account.
Prohibited Behavior
You agree not to access or use the Website or Service in any manner that:
- Is unlawful, illegal, fraudulent, or unauthorized;
- Violates applicable laws or regulations;
- Violates or infringes the rights of another person or entity;
- Attempts to gain unauthorized access to the Service, another Account, or related systems;
- Interferes with, disrupts, damages, overloads, or circumvents the Service or its security measures;
- Uses automated systems, scraping, bots, or other mechanisms in a manner not expressly authorized by OpenGen;
- Attempts to reverse engineer, extract, discover, copy, or replicate underlying models, source code, algorithms, or other proprietary technology;
- Systematically extracts Output Content or other data for the purpose of creating, training, or improving a competing generative artificial intelligence service without our express authorization;
- Circumvents usage limits, subscription restrictions, generation limits, moderation systems, or safety measures; or
- Uses the Service in a manner that could harm OpenGen, other users, our service providers, or third parties.
You may not upload, request, create, generate, edit, or distribute User Content through the Service that:
- Expresses, incites, promotes, or glorifies hatred based on protected characteristics or identity;
- Harasses, threatens, intimidates, exploits, or bullies another person;
- Promotes, celebrates, or meaningfully facilitates serious violence or suffering;
- Encourages or promotes self-harm;
- Sexually exploits or sexualizes minors or otherwise contains child sexual abuse or exploitation material;
- Uses the likeness of a minor in sexual, exploitative, abusive, or otherwise inappropriate content;
- Is intended primarily to create explicit sexual content where prohibited by the Service;
- Is created or distributed without necessary consent in a manner that violates another person’s privacy, publicity, or personality rights;
- Uses another person’s likeness, identity, or voice for fraudulent impersonation;
- Creates deceptive or manipulated media intended to mislead others regarding a real person’s actions, statements, or identity;
- Facilitates fraud, scams, phishing, identity theft, or other deceptive activity;
- Misrepresents AI-generated or AI-modified media in a manner intended to deceive others where such deception could cause harm;
- Infringes copyright, trademark, privacy, publicity, or other third-party rights;
- Contains malware, malicious code, or instructions intended to compromise devices, networks, or systems;
- Promotes or facilitates illegal products, services, or conduct;
- Is designed to improperly influence elections, voting, political processes, or public decision-making through deceptive impersonation or manipulated media;
- Violates any law or regulation; or
- Violates the applicable usage or content policies of third-party AI model providers used through the Service.
OpenGen may use automated systems and human review to detect or prevent prohibited activity.
We reserve the right to refuse generation requests, block prompts, remove content, limit features, suspend Accounts, or terminate access where we reasonably believe these Terms have been violated.
Our failure to prevent the generation of particular content does not mean that such content is permitted under these Terms.
Links to Other Websites
These Terms & Conditions apply only to the Services.
The Services may contain links to websites, applications, platforms, or services that are not operated or controlled by OpenGen.
We are not responsible for the content, accuracy, availability, security, practices, or opinions expressed by third-party services and do not necessarily investigate, monitor, or verify them.
When you access a third-party website or service through a link provided by OpenGen, these Terms may no longer apply to your interaction with that third party.
Your use of third-party services is subject to that third party’s own terms, policies, and practices.
Third parties may also use cookies, tracking technologies, or other methods to collect information in accordance with their own policies.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OPENGEN, THE COMPANY, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, OR PARTNERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFITS, LOST REVENUE, LOSS OF DATA, LOSS OF GOODWILL, OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF, OR INABILITY TO USE, THE SERVICE, WEBSITE, FEATURES, USER CONTENT, OR OUTPUT CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Access to and use of the Service are at your own risk.
You are responsible for reviewing Output Content before relying upon, publishing, distributing, or otherwise using it.
You are solely responsible for any consequences resulting from your use of Input Content or Output Content, including claims relating to intellectual property, privacy, publicity rights, defamation, misleading content, or other third-party rights.
We are not responsible for:
- Output Content generated by artificial intelligence;
- Similarities between Output Content and existing or third-party content;
- The availability or performance of third-party AI models;
- The temporary or permanent unavailability of particular models or features;
- Generation requests that fail or produce unexpected results; or
- Loss of User Content where such liability may lawfully be excluded.
To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the Service or these Terms shall not exceed the amount you paid to the Company for the Service during the period giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
Indemnity
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Company, its affiliates, directors, officers, employees, agents, contractors, and partners from and against claims, demands, actions, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising from or relating to:
- Your access to or use of the Service;
- Your Input Content;
- Your Output Content;
- Your publication, distribution, sale, commercialization, or other use of Output Content;
- Your use of another person’s name, image, likeness, voice, identity, copyrighted material, or other protected content;
- Your violation of these Terms;
- Your violation of applicable law; or
- Your violation of the rights of another person or entity.
We reserve the right, at your expense where permitted by applicable law, to assume the exclusive defense and control of any matter for which you are required to indemnify us.
You agree to cooperate with our defense of any such claim.
Dispute Resolution
Contractual dispute venue: ________________. Applicable mandatory consumer-protection rights remain unaffected.
If you reside in a jurisdiction whose laws give consumers a non-waivable right to bring disputes in their local courts or before another competent authority, these Terms do not override those rights.
The Parties agree that, to the fullest extent permitted by applicable law, disputes will be resolved between the Parties individually and not on a class, collective, consolidated, or representative basis where such waiver is legally enforceable.
Any dispute concerning the enforcement or protection of intellectual property rights, unauthorized use of the Service, theft, piracy, invasion of privacy, or requests for injunctive or equitable relief may be brought before a court of competent jurisdiction.
If any part of this Dispute Resolution section is determined to be illegal, invalid, or unenforceable, that portion shall be severed or limited to the minimum extent necessary, and the remaining provisions shall remain in effect.
Nothing in this section limits any rights you may have under mandatory applicable consumer-protection laws.
